A MAN who sexually assaulted a teenage boy at a motel in the Hunter, and who was handed an 18-month suspended jail sentence, avoided jail because it was an unusual case, Newcastle District Court heard.

Rodney Oxbrow, 59, of Port Macquarie, performed various sex acts on the 17-year-old on January 10 and pleaded guilty to sexual intercourse without consent.
Judge Stephen Walmsley said, even though the victim did not tell Oxbrow to stop assaulting him, Oxbrow took advantage of the boy.
The boy felt as though he couldn’t stop what Oxbrow was doing and ran for help as soon Oxbrow fell asleep, Judge Walmsley said.
Defence barrister John Booth read a letter Oxbrow addressed to the victim and the victim’s family.
“My heart is heavy knowing the damage I have caused,” the letter said. “I feel sick ... I am truly sorry for everything I have done.”
He was staying at a Belmont motel on January 10 when he offered to massage the 17-year-old boy, a statement of facts said.
The boy consented to the massage, but Oxbrow then performed a series of sex acts on the boy.
Oxbrow pleaded guilty to sexual intercourse without consent.
Mr Booth said Oxbrow had no criminal record and did not use force during the offence.
Oxbrow’s guilty plea was important because “it was not the most powerful case for the Crown’’, Judge Walmsley said.
