Legal stoush over fluoride in Hastings water

CAMPAIGNERS are considering legal action against Port Macquarie-Hastings Council as the introduction of fluoride into our water supply moves closer to inevitability.

Pending approval from the NSW Office of Water – likely to occur next week – the council’s fluoridation operation is expected to begin by early March. Two groups – Fluoridation Action Network Australia (FAN) and Citizens Against Fluoridation (CAF) – are determined to force the council to assume responsibility for the decision to fluoridate.

The groups also want the local government to hold a community poll on the issue at September's election.

Port News understands CAF plans to establish a fighting fund to help cover costs and will seek donations, should it pursue legal action.

The council maintains authorising fluoridation is a state government matter.

But FAN and CAF argue a legal precedent has been set in Ballina, in northern NSW.

The NSW Land and Environment Court ruled the shire council had failed to provide an assessment of the effects on both the environment and public health from the introduction of fluoride into the water supply there.

A second ruling is expected soon. Port Macquarie-Hastings Council has not prepared an environmental impact study.

An injunction could yet block the fluoridation operation here, a FAN spokeswoman said.

Council administrator Neil Porter yesterday quashed suggestions he would authorise a poll on water supply fluoridation at this year's local government election.

He indicated he would not support an application for a poll at the election as fluoridation was to begin soon.

The council is scheduled to introduce fluoridation after it has fulfilled its duty to publicise the new measure through the media, the council's website, letters to households and brochures.

The administrator's clarification follows statements by local members of FAN that Mr Porter had supported their calls for a community poll.

A FAN media release last week stated: ”Local members of the Fluoride Action Network Australia are delighted that Port Macquarie-Hastings Council has responded positively to a request for a community poll on the issue.’’

FAN has responded to the administrator's statement, expressing disappointment at his refusal to consider a poll.

Dr Caree Alexander, FAN spokeswoman and a former dentist, confirmed the group would proceed with a petition for the poll.

"Clearly the health department is behind this sudden change of heart by [the] council.

"In legal terms, the addition of fluoride, incidentally sourced as a waste by-product of fertiliser manufacture, remains a question for council and its community to decide."

The council's statement said Mr Porter had discussed the process required to conduct such a poll on any issue with a community member.

But the subject of fluoridation had not been brought up in this discussion.

The administrator said: "The council has been directed by the NSW Minister of Health to fluoridate the Hastings water supply and conducting a poll on the issue is not appropriate given this direction."

Mr Porter said the costs involved in an independent person or organisation organising the poll would be "considerable".

All these people moaning about adding fluoride are just trying scare off what has been proven useful around the world. I would note that these protesters, probably smoke, drink, are over weight and eat junk food- so what is worse??.! People that try and get on the moral high ground about these sorts of issues, and then lead unhealthy life styles themselves really get on my nerves. The benefits of fluoridation is well reached, and tested.

These groups represent such a very tiny section of the population.

If they are so worried about something that hundreds of millions of people ingest every day with no ill effects, surely they could just drink bottled water and let the rest of us get on with enjoying better dental health.

It would interesting to know what type of person is protesting against fluoride in our drinking water. I'm guessing they would be older and resistant to change.

Most of the people I mix with have young families - and most seem to be in favour of adding fluoride to the town drinking water.

Fluoride has been used in drinking water for over fifty years in many communities with No, I repeat No adverse side effects.

The advantage is stronger and healthier teeth.

My kids grew up with fluoride in their water and they have on average one or no fillings.

They are all in their late 30's and as far as I know, no serious health issues.

I came to Port Macquarie from Manilla.They started to use fluoride about 40 years ago and that town is known to have the highest cancer rate per population in Australia.

It really is the biggest waste of rate payers money as probably 99.9 percent of our water goes down the drain and a lot of our residents are retired and have dentures. If you want fluoride-go and buy some yourself !!

i often wonder when i read about the people protesting against the introduction of Fluoride in our water, i have a question for them have they ever been outside Port Macquarie? Have they been to Sydney or other capital cities or regional towns & drunk tap water? cause if they have there is Fluoride in most water systems....this is going to happen so build a bridge & get over it.....

@Nick - I have lived in Port for half my life. I am also aware that Sydney and other areas have flouride in their water supplies. When visiting those areas I elect to purchase water that does not have fluoride added to it for my drinking and cooking purposes.

Despite comments above, it has been proven that the topical -ie - direct onto the teeth - application of fluoride is effective in reducing dental caries. The ingestion of it in water supplies is questionable.

Putting this substance into your water is a cheap way for the Dept of Health to pretend to be doing something.

How many more times is this issue going to be raised ? The decision to add flouride was made years ago. Lets get on with it. If these groups dont like that decision then let them take legal action. Dont talk about it.....do it !

What a immature thing to say! Saying that because we have an aged population in Port why bother? I suggest you go back to Manilla. This town has plenty of youth, that will benefit for fluoridation in the water. Anything we can do to make things better for our young people the better. Teeth are the forgotten part of health, that in the long term can be very expensive, not t mention the impacts on poor health. Sorry Didi you rank the most stupid thing to say so far.

I do not believe that we should be subject to forced medication which is what happens when fluoride is in our tap water. If you want fluoride for your teeth ask your dentist to paint it on your teeth. Could we please have a choice in whether we use fluoride!! I don't want it! Many overseas countries have now ceased the use of fluoride in the tap water because they are aware of the dangers of it. It is a by-product of chemical fertiliser!!!!!!
